  • US Supreme Court decision day

    So far....

Faith-based initiatives: USSC held that the President can expand charitable grant eligibility to include faith-based organizations; churches, temples. mosques etc., ruling that "ordinary citizens" do not have standing to challenge the policies in court. Atheist groups had challenged them.

Freedom of speech: USSC held that a student who unfurled a banner reading "Bong Hits 4 Jesus" at a school sponsored event across the street from the campus did violate the schools policy against promoting drugs and that the rule was reasonable. Another overturning of the "9th Circus" court.

Environment: USSC held that when the Clean Water Act and Endangered Species Act conflict the Clean Water Act wins. The case involved both the National Association of Home Builders and the Environmental Protection Agency vs. the organization "Defenders of Wildlife". Yet another overturning of the "9th Circus" court

Securities fraud: USSC held that lower courts must weigh possible innocent explanations for defendants' conduct at the very start of a securities fraud case. Doing so can lead to early dismissal of investors' lawsuits. The ruling came in a shareholders suit against high-tech company Tellabs Inc.

Campaign Ad Restrictions: USSC ruled that companies, labor unions and interest groups have greater rights to run broadcast ads before elections, limiting the reach of the McCain-Feingold campaign-finance law. The provision in question was aimed at preventing the airing of "issue ads" that cast candidates in positive or negative lights while stopping short of explicitly calling for their election or defeat.

Property taxes on diplomatic missions: USSC holds that the portions of buildings owned by diplomatic missions not used for diplomatic purposes or as residences for defined diplomatic officers are taxable under local property tax provisions. India had claimed that the 20% of their UN mission used as free housing for non-diplomatic employees was exempt.
