Yes, PFC is required here for units to be sold. You may, as a private individual, of course still use your old non-PFC PSU (and even if you weren't allowed, who would care?), but in order to be llowed to sell a PSU, it must be corrected.

BTW, if you haven't bought yet, take a look at the Seasonic SS-350FB ("Super Tornado"). Very quiet (almost inaudible under small loads) and high quality.

Just make sure the vendor can guarantee it's a Rev 3 model - the Rev 2's have some "problems" with the fan control circuitry apparently.

Of course I bought one ... this was a brand new system and I needed a new PS. I did get the SilverStone Strider SST-ST40F PFC PS. I actually tried the Seasonic out and I like the SilverStone better in every way. I love the internal right-angle 120 mm fan sucking heat right off the CPU and graphics card. There is no outer exhaust fan so it helps reduce noise. It also has better cabling and outer appearance and it of course goes perfectly (form and function) with my SilverStone case. The PS certainly isn't the noisiest component in my PC ... in fact it isn't even among the top three noise polluters (I measured it). My main source of noise right now is a full on little rear case fan. I need to get my thermal management under control but I'm busy just getting the functionality up right now.
