Personally I don't think Valve have a leg to stand on - that cd-key is not illegal. There is no such thing as an illegal cd-key.
Microsoft didn't dare to disable Windows with SP1 or SP2 for people who used dodgy keys - as they knew that plenty of people with legit copies, used that key for convenience.
It's not a case of them banning the cd-key it's more a case of them banning accounts which may have spent money on the game.
Daft thing is that they are only getting people that actually use the system properly, and are most likely attempting "casual" piracy. The warez version doing the rounds doesn't connect to Valve at all, so won't be affected.
