No big shock that the scientists used the 9th circuit court of appeals to steal the bones away from the Native Americans... farg'n 9th circuit court of appeals.

Agree about the 9th circuit....what a bunch of maroons. Last I checked they are the most reversed federal circuit court in the nation

That said: IF, as the scientists think, Kennewick Man is NOT an ancestor of the current Native Americans why should they have a say in what is done with his bones?

The NA's ancestry only dates back to about 14,000 years or so, but recent findings by some european scientists show that other waves of migration from Asia go back as far as 40,000 years.

Seems prudent to me that at the very least they should have to establish Kennewick Mans status before they can lay claim to him, but then this brings in the politics of the situation.

NA's have laid claim to a lot of early human sites by claiming them as holy ground etc., bottling up research on many fronts. They're doing the same here, but this time there is evidence that their claim is invalid.

IMO what they're really upset about is that once it's shown that some group was heree before them future claims on their part will have to meet a higher standard of proof, and God forbid that some special interest group have to meet a high standard of proof

Only by raw quantity. They also try the most cases. If you look at percentages, they are overturned less than some other circuits.
