  • Libbers lose a big one....

Child custody cases in the US may never be the same if decisions keep going against custodial "move aways"....

Thank god there is some allowance for fathers finally being made.

It is not a "Libbers" issue in reality (though some of them may claim it). It is about valuing fathers as parents. Woman's liberty is not furthered by giving them cart blanc in how and where children are raised. Hell, in this case, the woman was moving to follow some other man. How liberated is that?

All in all, kids should win, every time.

I totally agree, and pulling this "move away" crap dosn't make the cut.

What if the (non-custodial) dad decides to move?

Should the judge always decide that the kids should stay in the same place?

If either parent moves away, the kids will lose some contact with one parent. Whether it makes sense to change custody is still subject to the actual living conditions with either parent.

It makes sense that the judge should primarily be considering the welfare of the children, but it doesn't make sense that the parents should be forced to live in the same town, or that if the custodial parent moves, that they have to leave their kids behind.
