    A conditional declaration of war

    This Joint Resolution of Congress is expected to pass both houses of the US Congress with huge majorities of both parties within a week.

    UN Security Council intrangiscence will do Saddam no good whatsoever. The President has been given authority to take action with or without their sanction if what action they take is deemed to be insufficient.

    Skipping most of the perfunctory Whereas's;

    Whereas it is in the national security of the United States to restore international peace and security to the Persian Gulf region;

    Now, therefore, be it Resolved by the Senate and House of Representatives of the United States of America in Congress assembled,

    SEC. 1. SHORT TITLE.

    This joint resolution may be cited as the "Authorization for the Use of Military Force Against Iraq".

    SEC. 2. SUPPORT FOR UNITED STATES DIPLOMATIC EFFORTS

    The Congress of the United States supports the efforts by the president to

    (a) strictly enforce through the United Nations Security Council all relevant Security Council resolutions applicable to Iraq and encourages him in those efforts; and

    (b) obtain prompt and decisive action by the Security Council to ensure that Iraq abandons its strategy of delay, evasion and noncompliance and promptly and strictly complies with all relevant Security Council resolutions.

    SEC. 3. AUTHORIZATION FOR USE OF UNITED STATES ARMED FORCES.

    (a) AUTHORIZATION. The president is authorized to use the Armed Forces of the United States as he determines to be necessary and appropriate in order to

    (1) defend the national security of the United States against the continuing threat posed by Iraq; and

    (2) enforce all relevant United Nations Security Council Resolutions regarding Iraq.

    (b) PRESIDENTIAL DETERMINATION.

    In connection with the exercise of the authority granted in subsection (a) to use force the president shall, prior to such exercise or as soon there after as may be feasible, but no later than 48 hours after exercising such authority, make available to the Speaker of the House of Representatives and the president pro tempore of the Senate his determination that

    (1) reliance by the United States on further diplomatic or other peaceful means alone either (A) will not adequately protect the national security of the United States against the continuing threat posed by Iraq or (B) is not likely to lead to enforcement of all relevant United Nations Security Council resolutions regarding Iraq, and

    (2) acting pursuant to this resolution is consistent with the United States and other countries continuing to take the necessary actions against international terrorists and terrorist organizations, including those nations, organizations or persons who planned, authorized, committed or aided the terrorists attacks that occurred on September 11, 2001.

    (c) WAR POWERS RESOLUTION REQUIREMENTS.

    (1) SPECIFIC STATUTORY AUTHORIZATION. Consistent with section 8(a)(1) of the War Powers Resolution, the Congress declares that this section is intended to constitute specific statutory authorization within the meaning of section 5(b) of the War Powers Resolution.

    (2) APPLICABILITY OF OTHER REQUIREMENTS. Nothing in this resolution supersedes any requirement of the War Powers Resolution.

      Just tellin' the facts man....just the facts.

      The Prez and the Congressional leaders of both parties did what we in the States call "a Rose Garden". This means they appeared together in front of the cameras to show it really is a joint decision with wide support.

        I heard something on the News at lunch that the UN is trying to pass some resolution that will be tougher on Iraq concerning weapons inspection, thus hopeful adverting an all out war, but that there will still be a number of sites that will still be labeled as off limits.

        I think if they really want to get tough and advert a war then the wording should be "We will inspect where ever we damn well please without prior notification and if you don't like it...tough."

          We both know it won't be more than balls and whistles.

          The inspectors will come somewhere, their access will be "mistakingly" / "grave error" denied till some time later and by then everything will be clean and tidy.

          Just like when the last politician (from Germany) that came to visit Arafat told Sharon that the IDF must let Arafat work. Sharon asked the politician "Did he look at you straight in the eye and said he'll do anything in his power to stop the terror ?", the politician said "Yes, exactly that", so Sharon said something like "Yes yes, exactly like all the other times. Maybe you buy that, we don't."

          Saddam seems to be playing the exact same game.

              This is what the US wants: the ability to search anywhere, anytime and without notice including such locations as the "Presidential Palaces" without interference or limitation by the Iraqi government or any other in-country organizations.

              Absent that we're gonna take out the S.O.B.

              IMHO they'll never do it. They've been successfully pulling the wool over the UN's eyes for so long they just can't fathom being called to task on it.

              VLIP: the administration has also stated that enforcement of those resolutions are also on the list, but one thing at a time.....

                Isn't that this club where a terrorist country sits as a president of the SECURITY COUNCIL ?
                The same club who's soldiers and politicians collaborated with a terror organisation controlled by the president of the security council - called Hizbolla ?

                  Haim Avraham, the father of a kidnapped Israeli soldier, who is believed to be held, or possible killed by Hizbollah forces put it best for Israelis: "Larsen and his organisation are clearly unobjective. They lied to my face when he said the UN didn't have a tape of my son being kidnapped. We know now they do have one! And they hid it from us. Larsen never spoke of the horrible thing that happened to my son. I've never heard him say a word about the terror we live in".

                  The tape the UN hid from Avraham raises heavy suspicions of UN soldiers ignoring the Israeli soldiers distress during the kidnapping. Avraham's words say it best for the Israeli street, who today have lost pretty much all faith in the UN.

                    The UN is also the same group that voted the US off the Human Rights Commission. Of course China & a few other states with less than stellar records are now running it

                    The President has made it clear that states that support terrorism are at risk. So far he's been taking them on one at a time and looks to be a man of his word. Just ask the Taliban

                    My bet is that Syria/Husbullah & company are next on the hit list after Iraq.

                          thank you for the heads up Dr. mordrid... since hizboulah is on the target list and i live in lebanon id better start rationing my suplies.....

                          let me put it to you this way.... i don't care much about syria (i want them out of the country) and i would like to see hizboula disarmed... but here is the situation; the minute hizbulah is ataked lebanon is going to plunge into another civil war.....

                          do you realy think that war is the only option?

                            Don't know what to answer you Spiral.
                            I do KNOW that if and once the border between Lebanon and Israel opens, a lot of money will flow and Lebanon might very quickly return to it's old glory as the pearl of the ME.

                              It was reported here that they Will have access to all sites...

                              The only thing is, as I understand it, is that any inspectors must be 'escorted' when visiting some of Saddams 'private Palaces'....

                              They arent off limits though....
